1. Provider and Scope of Application
These Terms and Conditions govern the use of the Praktiker portal under praktiker.meine-tcm.com („Portal“) by you as a therapist in the field of Traditional Chinese Medicine („Practitioner“).

2. Portal Services
On the portal We offer you:
- a listing in the public Praktiker directory at www.meine-tcm.com
- Management of patients, appointments, treatments, and initial consultations
- Creating and Sending Invoices
- Participation in the meine-TCM Partner Program (Item 6)
Use Use of the portal is free for you. Your earning potential through the affiliate program is outlined in Section 6.
3. Registration and Activation
For use Register using a valid email address. After email verification, we will manually review your credentials. We’ll activate your public profile as soon as the requirements for practicing TCM in your country are met. If no formal certification is required for your profession, you can confirm this in your profile by checking the corresponding box.
4. Your Responsibilities
You agree to:
- Keep your login information confidential
- to provide truthful information about qualifications and work experience
- Handling patient data in accordance with the GDPR and professional confidentiality obligations
- to upload only lawful content
- not to use the portal for improper purposes
5. Patient Data
For patient data, the information you enter in the portal (name, appointments, test results, treatment notes) is You, the person in charge in accordance with the GDPR. We process this data as Data Processor In accordance with Article 28 of the GDPR, this data is used exclusively to provide the portal’s functions. We will provide a data processing agreement (DPA) upon request.
6. meine-TCM Affiliate Program
Upon registration You are automatically enrolled in the affiliate program. You can choose from three participation models and switch between them at any time.
6.1 Affiliate (Standard)
You recommend products via email from www.meine-tcm.com to your patients and receive a Commission of 10 % of the net order value.
- Assignment: The commission goes to the practitioner whose affiliate link was used by the patient most recently was clicked (last-click attribution). The attribution window is 30 days. A subsequent click by another practitioner overrides the attribution.
- Origins: The commission is not earned until the order is marked as „completed“ in the store (payment received). In the event of a cancellation or refund, the commission is reversed.
- Cancellation Period: 14 days from the date the order is placed. After this period, the commission is considered confirmed.
6.2 Discounted Purchases
You buy products Purchase products yourself at discounted partner rates, maintain inventory, and sell directly to your patients. Current discount compared to the regular store price: 22,5 %. We can change the sentence with advance notice.
Prerequisite: You enter a Trading Company (business), through which purchasing is handled. Purchases are made in the online store with automatic login from the portal; inventory management and goods receipt are handled in the portal.
6.3 Non-participation
You can Switch to „Do Not Participate“ at any time. Ongoing transactions (outstanding commissions, remaining inventory) can still be finalized.
6.4 Model Change
The Change You can switch between models at any time. For security reasons, the change will not take effect until you have clicked on a confirmation link in an email sent to your login address.
6.5 Commission Settlement (Credit Memo Process)
Commissions are via Credit Note Pursuant to Section 11(8) of the Austrian Value-Added Tax Act (UStG) or § 14(2) of the German Value-Added Tax Act (UStG). You agree that we will issue a credit memo on your behalf on a monthly basis.
- Billing Period: Calendar Month
- Payment will be made on the 15th of the following month via SEPA transfer to your registered payout account
- Minimum threshold: 100 EUR; smaller amounts carry over to the following month
- 14-day objection period on the portal. Unless you object, the credit will be considered accepted.
- If an order is canceled after payment has been made, we will include the chargeback as a negative line item in the next credit memo.
6.6 Tax
They pay taxes on Your commission income. In the portal settings, you can specify your status under the small business regulation and, if applicable, your VAT ID number. The display of sales tax on the credit memo is based on this information. The tax exemption for healthcare professionals (§ 6(1)(19) UStG AT) applies not for commission income.
6.7 Buyer Information
On the portal You will see anonymized buyer email addresses (e.g., j***@g***.com). Full contact information is disclosed only as part of a dispute resolution process or upon government order.
7. Profile Lock
We can We may block or deactivate your public profile in the event of reasonable doubts regarding your qualifications, repeated violations of these Terms of Service, or valid complaints that justify suspension. We will notify you in advance and give you the opportunity to respond, provided this is practically feasible.
8. Liability
We present We operate the portal with the due care expected in the industry, but do not guarantee uninterrupted availability.
Our Liability is limited to willful misconduct and gross negligence. In cases of ordinary negligence, we are liable only for breaches of material contractual obligations, and the amount of liability is limited to the typically foreseeable damage. Liability for lost profits, consequential damages, or business interruptions is excluded to the extent permitted by law.
For content, You are personally responsible for the documents you create (invoices, patient notes, referral emails).
9. Term of the Agreement and Termination
The Contract will continue indefinitely.
- You may cancel at any time with 14 days' notice.
- We may terminate the agreement with 30 days' notice.
- The right to terminate the contract for cause remains unaffected.
After termination Please export your data. Outstanding commissions will be paid out as part of the next settlement. Accounting records must be retained for 7 years by law.
10. Amendments to These Terms and Conditions
We can We may amend these Terms and Conditions if required for legal, technical, or economic reasons. We will notify you on the portal and via email. You have a 30-day right to object. If you do not object, the new Terms and Conditions will be deemed accepted; if you do object, you may terminate the agreement in accordance with the standard procedure.
11. Governing Law and Jurisdiction
The following applies Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive venue for legal proceedings is—to the extent permitted by law—the Provider’s place of business. With respect to consumers, the statutory venues for legal proceedings apply.
